Burnaby's Tree Bylaw — The Threshold Most People Get Wrong
Burnaby does not use a single diameter threshold, and this is where most homeowners are caught out. Under Tree Bylaw 1996 (Bylaw No. 10482), on a property NOT subject to a development application a tree cutting permit is required for any conifer 30 cm (12 inches) or greater in diameter, and any deciduous tree 45 cm (18 inches) or greater. On a property that IS subject to a development application, the threshold drops to 20 cm (8 inches) for any tree, regardless of species. A cedar and a maple on the same lot can therefore sit in completely different permit positions.
That development-status distinction matters enormously in Burnaby, where Metrotown, Brentwood and Edmonds are under sustained densification. A tree that needed no permit last year can become protected the moment a development application is filed on the property. Replacement Trees: What Burnaby Requires After a Removal
Burnaby ties replacement planting directly to the size of the tree removed. A tree 8 to 12 inches in diameter requires 1 replacement tree. A tree 12 to 24 inches requires 2 replacement trees. A tree 24 inches or more requires 3 replacement trees. This is a real cost and space consideration that is often left out of a removal quote — and it is the part homeowners discover after the tree is already down.
The replacements carry their own specifications. Coniferous replacements — Douglas fir, Hinoki cypress, spruce — must be a minimum of 2 metres high. Deciduous replacements such as redbud, dogwood, maple or magnolia must have a minimum 5 cm trunk diameter. Two fruit trees count as one replacement tree, or a single fruit tree counts fully if it is 5 cm or greater in diameter. Palms must be a minimum of 2 metres high. Replacements must be planted on private property with at least 3 metres between trunks, and must be allowed to grow to full maturity.
